Reservation Terms
& Refund Policy

Effective May 9, 2026

These terms govern every reservation placed with MDS Executive Transportation ("MDS", "we", "us", "our"). By submitting a reservation request and paying the $200 deposit, you ("Client", "you") expressly agree to be bound by them.

Reservation & Confirmation

A reservation request is initiated when you complete the booking form and pay the $200 USD non-refundable deposit through PayPal. A reservation is confirmed only when MDS sends a written acknowledgment (email or SMS) within one hour of your request, validating availability and pickup details.

MDS reserves the right to decline any reservation. If we decline, your deposit is fully refunded within five (5) business days.

Deposit & Final Fare

The $200 deposit is required to secure the vehicle and chauffeur for the requested date and time. The deposit is applied in full toward the final fare and is non-refundable except as expressly provided in Sections 04, 05, 06, and 08 below.

The final fare is calculated based on distance, duration, vehicle class, and any agreed surcharges (after-hours, holidays, additional stops). The remaining balance is due upon completion of the ride and is settled via PayPal, credit card, or wire as agreed at confirmation.

Cancellation by the Client

All cancellations must be communicated by phone (+1 347 274 7728) or email and acknowledged in writing by MDS to be effective. The deposit treatment depends on notice given, measured against the scheduled pickup time:

If MDS must cancel due to vehicle unavailability, chauffeur unavailability, or any operational reason within our control, you will, at your sole election, receive:

Late Arrival by MDS

We commit to arriving ten (10) minutes prior to your scheduled pickup. If our chauffeur arrives more than thirty (30) minutes after the scheduled time and the delay is not caused by traffic, weather, road closures, or any third-party event, the deposit is refunded in full upon written request.

Vehicle, Chauffeur & Conduct

Vehicle preferences are honored subject to availability. MDS reserves the right to substitute the vehicle with one of equal or higher class. All chauffeurs are licensed, insured, and have passed background checks.

Smoking, vaping, and illegal substances are strictly prohibited inside the vehicle. Violation incurs a $250 cleaning fee charged to the Client. Damage caused by the Client or any member of their party (spillage, soiling, broken interior or trim) is billed at actual repair cost as documented by a licensed repair facility.

Force Majeure

Neither party is liable for failure or delay in performance caused by circumstances beyond reasonable control, including severe weather, road closures, accidents, governmental orders, civil unrest, or acts of God. In such events, MDS will, at the Client's election, reschedule the ride at no additional cost or refund the deposit in full.

Liability

MDS carries commercial automobile liability insurance in compliance with applicable state and federal law. MDS is not responsible for delays caused by traffic, weather, road conditions, or third-party events outside our reasonable control.

MDS is not responsible for personal items left in the vehicle. We will use reasonable efforts to return any found items at the Client's cost. Maximum aggregate liability of MDS for any claim arising from a reservation is limited to the total fare paid for that reservation.

Privacy

Personal information collected through the booking form (name, phone, email, pickup and drop-off locations, payment data) is used solely to operate your reservation and communicate with you about it. MDS does not sell or share your data with third parties, except with payment processors (PayPal) strictly as required to process the deposit and final fare. We retain reservation records for the period required by applicable tax and commercial law.

Disputes & Chargebacks

All billing disputes must first be raised directly with MDS in writing within thirty (30) days of the disputed transaction. We commit to acknowledge such disputes within two (2) business days and to resolve them in good faith.

Filing a chargeback or payment dispute with PayPal, your card issuer, or any other third party without first contacting MDS as above constitutes a material breach of these Terms. In any chargeback proceeding, MDS will submit, as supporting evidence, a copy of these Terms, your booking confirmation, your written agreement evidenced by clicking the PayPal payment button, and any communications and documentation regarding service readiness or completion.

Where the deposit was clearly disclosed and you confirmed payment, the deposit is enforceable as a non-refundable liquidated charge under Sections 02 and 03 above.

Governing Law & Venue

These Terms and any dispute arising from a reservation are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Exclusive venue for any judicial action is the state and federal courts located in New York County, New York.

Modifications

MDS may update these Terms from time to time. The Effective Date at the top of this page reflects the most recent version. Material changes will be communicated by email to clients with active or recent bookings. Reservations placed after a change are subject to the version then in effect.
